MUMBAI: Despite getting bail from the Bombay high court on Wedesday, actor Shiney Ahuja has to spend another night in jail as the sessions court principal judge on Thursday declined to accept the bail of Rs 50,000 in cash and asked for a surety.
The sessions court said a clarification on whether cash bail can be accepted or not as the HC order mentioned "same bail (as granted earlier to him) and fresh bond".
Ahuja was arrested in June, 2009 and later sent to jail for allegedly raping his domestic help.
After the person who had earlier stood as surety took back his bond, the actor's wife, Anupam, stepped in. She produced a fresh solvency certificate but the court said for verification, it would be sent to the tehsildar who had issued it. The tehsildar will have to confirm that he did issue the solvency certificate that stated she was solvent for Rs 2 lakh, based on property documents.
Anupam was allowed to visit the Oshiwara police station to have her address verified and the investigating officer will submit a report to the court on Friday.
Lawyers said Ahuja could challenge the delay of his release in the HC as there were several Supreme Court judgments saying bail bonds must be accepted immediately because verification could take time. And in this if it is sent by ordinary post, it could defeat the SC order of not delaying liberty once bail is granted.
